The following terms and conditions apply to the use of the mailFISH service. The operator of the service is referred to as "we", the user of the service is referred to as "you" in the following.

• The use of the mailFISH is free. Costs may only arise from the explicit purchase of additional mail transfer credits.
• The mailFISH service is provided "as is". None of its users has any kind of claim on the extension and/or modification of the service. In particular, we can not guarantee that the mailFISH can be used from a particular operating system.
• The mailFISH POP3/SMTP proxy client software is available for free download at serFISH.com. It is not allowed to translate, reverse-engineer, reverse-compile, decompile, disassemble, make derivative works or otherwise attempt to discover any source code from the provided software. In particular, it is strictly forbidden to use the free version of the mailFISH client to access tunnelling servers other than serFISH.com.
• It is not allowed to redistribute the closed source part of the mailFISH client software in any form. In particular it is strictly forbidden to sell the software or related services to third parties. As regards the included libraries, please refer to the respective license agreements.
• You understand that the use of the mailFISH is at your own risk and that we provide only the assistance available through the documentation available on www.serfish.com. We are under no obligation to provide you with error corrections, updates, upgrades, bug fixes and/or enhancements of the software.
• Our entire liability and your exclusive remedy with respect to any dispute is to discontinue the use of our software and services. The operators of serFISH.com shall not be liable for any indirect, special, incidental, consequential or exemplary damage arising from the use of the provided software and services.
• The user of the mailFISH has no claim on the availability and quality of the provided software and services. As we can not guarantee the correct transmission of data and/or any particular level of performance, no compensation can be provided for the loss of data and any kind of potential damage that might occur.
• The operator of the service reserves the right to restrict the interval in which mailboxes can be accessed through serFISH.com to a reasonable period (e.g. 10 minutes). This is also true for users that purchase additional transfer credits.
• The operator of the service reserves the right to restrict the overall size of messages transferred through serFISH.com to a reasonable amount (e.g. 100 MB for 25 messages). This is also true for users that purchase additional transfer credits.
• Whenever the mailFISH client fails to directly connect to the given mail servers, all POP3/SMTP communication is tunnelled through serFISH.com. There, all data is available in unencrypted form. We only log statistical information on transmissions made through our servers (in particular: the number of messages sent and received by use of our tunnelling service). The sensible data you send through our system (such as passwords and message contents) is not being logged. We will not disclose any data to third parties unless they have the legal right of access.
• It is not allowed to use the mailFISH for any kind of malicious act or illegal purpose. In particular it is strictly forbidden to use the provided service for denial-of-service attacks, spamming, break-in attempts and other attacks.
• The service must not be accessed by any kind of automated script or program other than the software provided on serFISH.com.
• Any attempt of violating the rules defined in these terms and conditions will be logged and prosecuted.
• The purchase of additional transfer credits makes it possible to tunnel additional E-Mail messages through serFISH.com. If the mailFISH client can connect directly to your mail servers, no such credits are used.
• The mailFISH service does not make any difference between the clients accessing a single mailbox. It is thus your responsibility to make sure that only authorized persons access your mail account via the mailFISH.
• It is up to you to test if sending and receiving messages by use of the mailFISH works for your E-Mail account. As no refund is possible, please try to send and receive E-Mails, attachments, etc. through the mailFISH prior to purchasing mail transfer credits.
• Please provide a valid and non-temporal E-Mail address as this address is the only mean by which we can identify you and get in touch in case of technical problems or credit issues. If you provide a wrong/invalid E-Mail address, your additional credit volume may be disabled without notice. Note that no refund is possible in this case.
• Upon the purchase of additional credits, we will process your order as quickly as possible. Still, there might be a slight delay in the availability of your additional quota as we have to wait for your payment to be cleared.
• Each purchase of additional credits is bound to exactly one E-Mail address. It is neither possible to transfer credits to another E-Mail account nor to get a refund for unused credit volumes.
